I was watching Montel Williams today and I saw your story. I cried for you! I am a Medical Assistant with Limited X-Ray and an EMT- Basic. With everything I have ever seen your story definatley put the icing on the cake. I will pray for you in my everyday prayers and also that this will never happen to another person again. I have just seen part of your story on Montel Williams. It is probably a repeated episode, but very worth watching. As all the stories are appalling. I have been a nurse for only 10 years, with a primary focus in Medical-Surgical Nursing. I have cared for many abdominal surgeries and have fortunately not seen anything quite as appalling as what you went through. I hope that you will recover (even if over many years). I have only witnessed incompetence by a surgeon through my own family member (sister), it has been a long healing process for her, in fact she is not thoroughly healed. A life of many medications, narcotics included, have altered her life forever. Her lawsuit was a bit more than what you received, however, it was not what it should have been. This is our Country's system. Surgeons and Physicians must be held accountable, the whole legal system in regards to medical malpractice and incompetence must be overhauled, of course, you know this, firsthand. MD's are not perfect, they're not gods, they're not the "end all to be all", as many of them feel they are. What you are doing by disseminating your ordeal and having a web site is a great way to get your story out to the public. Yes, mistakes do happen in medicine, but honesty, accountability and acknowledgement must be a mandate in the health care field. Patients must be compensated for their ordeal, and I wish for you the compensation you deserve, but most importantly I wish for you a healed life. Keep fighting, you're efforts will make a difference, even if you must fight congress, you can win, if not for yourself, your efforts can help someone else. Be well, Dan. D.A. Although my speciality was nursing homes, I am quite familiar with hospital issues, as well. I have reviewed records for attorneys that have cases pending litigation. I am just reviewing my background to show that I know what I am talking about.I am sorry about what happened to you and although nurses and doctors make mistakes, this, I have to say, is something that should have NEVER happened. It has always been standard practice to check sponges, etc prior to and after surgery. Having worked in surgery/recovery room in the sixties, I recall doing a count before and after and being, more than, aware of what was used. A retractor of the size (left inside you) has no reasonable explanation. My question would be, simply put, What were the staff doing when this instrument was not taken out of you? Again, I am so sorry about your bad incident. If you need help in providing information for consumer awareness/education, please let me know. Daniel Jennings, Dan, I had a similar experience in which my surgeon sent me home after an outpatient gallbladder surgery and never said to me that he cut off my small colon by mistake. I was in hospital for 3 months after that. This doctor is still practicing at Scripps Mercy in SD. The $250,000 allowed today is not worth fighting for so this surgeon will continue hurting other patients. I am living on medication for the rest of my life now because of his mistake. Dan, I just wanted to tell you how sorry I am that this has happened to you. I live in San Diego and was horrified to hear that this happened at Palomar Hospital. I cannot even begin to imagine what you have gone through and how this has affected your life. Thank you for sharing your story and educating others. I have to go in for a surgery myself here in the next month and found this site very informative. Please know that I admire your strength and courage. You are in my thoughts and prayers, TM I AM A RETIRED O.R. NURSE AND WAS ADHORED AT THIS SITUATION. I WROTE PROCEEDURES IN THE O.R. THAT WERE REQUIRED BY THE JOINT COMMISSION AND THEY INCLUDED SPONGE, NEEDLE AND INSTRUMENT COUNTS. THAT WAS IN AND BEFORE 1986 IN ILLINOIS. WAS CALIFORNIA BEHIND THE TIMES? They say a picture is worth a thousand words - well, there are no words. You have told me for months now about the trauma of your surgery and I grieved for you. However, it didnt really hit home until I saw the pictures. I am outraged at what they did to you. I just hope that the final outcome will be one that will finally give you some peace. That is absolutely unbelievable. To leave a 14-inch instrument, and not be found negligent?!?! I will keep you in my prayers. Doctor's like this not only need to be stripped of their license, they ought to pay money to their victims for the rest of their lives. I certainly hope your appeal goes through.It saddens me to think that your family and friends think you should just cut your losses. Although that is the only choice you have right now, how can anyone forgive someone for a mistake that they are not willing to admit to? Those who haven't been through something like you've been through obviously don't know how difficult it is to just "move on". As you mentioned on the website, SOMEONE needs to take responsibility for what happened to you. Accidents, yes, but NEGLIGENCE is another story!! Thanks again for the update.
